DMCA Copyright Policy

GoDealPro LLC ("Go Deal Pro," "we," "us," or "our") respects the intellectual property rights of others and expects users of the Platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the Platform that are reported to our Designated Copyright Agent identified below.

1. Designated Copyright Agent

Our Designated Agent to receive notifications of claimed infringement, registered with the U.S. Copyright Office (Registration No. DMCA-1074967), is:

2. Submitting a DMCA Takedown Notice

If you believe that content on the Platform infringes your copyright, please send a written notification to our Designated Agent at the address or email above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

1. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list of such works);
2. Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material — for listings or photos on the Platform, please include the listing URL or GDP number and identify the specific photo(s) or content at issue;
3. Your contact information, including your name, mailing address, telephone number, and email address;
4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and
6. Your physical or electronic signature.

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material expeditiously and will notify the user who posted it.

Please note: under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3. Submitting a Counter-Notice

If material you posted was removed or disabled and you believe the removal was the result of a mistake or misidentification, you may submit a written counter-notice to our Designated Agent at the address or email above. To be effective under 17 U.S.C. § 512(g)(3), your counter-notice must include:

1. Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled;
2. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification;
3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the Western District of Washington), and that you will accept service of process from the person who provided the original notification or that person's agent; and
4. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the party who submitted the original takedown notice. If that party does not notify us within 10 business days that it has filed an action seeking a court order against the user, we may restore the removed material in accordance with the DMCA.

4. Repeat-Infringer Policy

Go Deal Pro has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also, at our sole discretion, limit access to the Platform or remove the content of any user who infringes the intellectual property rights of others, whether or not there is repeat infringement.

This policy is part of, and should be read together with, our Terms of Service, under which users warrant that they own or have all necessary rights to the content they upload and agree to indemnify Go Deal Pro against claims arising from their content.
